November 2019 Criminal prosecutions under MLR 2007 and MLR 2017:

I recently made a series of requests for information of the Ministry of
Justice (MoJ) regarding criminal prosecutions under Money Laundering
Regulations 2007 (MLR 2007), the Money Laundering Regulations 2017
(MLR 2017), and under sections 330 and 331 of the Proceeds of Crime
Act 2002 (POCA) (collectively the regulated offences). I received a series
of responses from the MoJ, the relevant detail of which I have set out
below, and which I provide here by way of background in order to narrow
and to focus the scope of my request of the FCA.

In respect of the FOIA requests made of the MoJ, I discovered that the
latest available figures indicate that no proceedings have been instituted
for any offences under Part 9, Chapter 3 of the MLR 2017.

I have set out the information above in order to assist you in providing
me with a response to the following questions:

1. Which of these prosecutions were instituted by the FCA?

2. For each individual prosecution please specify the offence proceeded against
(i.e. whether Regulation 45 or 46 MLR 2007; section 330 POCA; or section 331 POCA)

3. For each individual prosecution under MLR 2007 please indicate which type of
regulated business under Regulation 5 was prosecuted

4. For each prosecution for any of these offences brought by the FCA please could you
provide the following details:

- The name of prosecution counsel;

- The name of the Judge who heard the case;

- A case summary/MG5 (or equivalent);

- A charge sheet;

- The outcome (whether the prosecution resulted in conviction or not;
guilty plea or finding of guilt; and disposal);

- For prosecutions which ended in conviction, a copy of the Judge's
sentencing remarks or a note of the same;

- For prosecutions which ended in acquittal, the reasons for acquittal
(i.e. not guilty verdict/prosecution offer no evidence; and

- Any press release originating with the FCA, or any press articles
you are aware of, which was created before, during or after the proceedings.

If you consider it necessary I am content for the above material to be
redacted for sensitive data (e.g. defendant's name and other identifying details).

5. Please could you also confirm whether the FCA has prepared any
guidance (internal or otherwise) in respect of the prosecution of any
of these regulated criminal offences?
In particular, I note that breaches of the MLR 2007 and MLR 2017
can be dealt with using either the civil or the criminal powers available
under those regulations.
I am interested to understand how the FCA reaches a view as to what conduct
will be considered so serious that it should be treated as a potential criminal offence,
rather than investigated in a civil enforcement context.
I therefore request the disclosure of any such guidance which provides assistance to the
FCA in determining the appropriate form of investigation (civil or criminal).

6. Finally, please could you confirm how many ongoing live single or
dual track investigations the FCA is currently investigating which involve
a potential or alleged criminal breach of the MLR 2017 and/or MLR 2007.

For each investigation please indicate which individual regulation or regulations
are being investigated as criminal breaches (for example 'Regulation 24 - Training, MLR 2017'
or 'Regulation 33 - EDD, MLR 2017' etc).

  • Please provide any and all estimates the FCA has conducted with regard to how many advice firms could exit the DB transfer market under the proposed changes.
  • Please provide any and all estimates of what the FCA considers to be a “sufficient” number of firms to service DB transfer advice demand and how this conclusion has been arrived at.

Would it be possible to disclose the split of UK financial advisers between independent and restricted for as many years as possible?  Rather than number of firms, I was looking for the number of actual financial advisers.  For reference, I believe the total numbers were: 2017 - 26,311; 2016 - 25,611; 2015 - 22,557; 2014 - 21,496; 2013 - 21,881; 2012 - 20,453; 2011 - 25,616, etc.  I am looking for the split of each of these numbers between the independent and restricted channels.

  1. Where you have referred to ‘registration’, we believe this to mean application for authorisation by the FCA? Yes – authorisation.
  2.  Rejections of authorisation applications, are you referring to where application for authorisation is denied by the FCA? Yes – where the application to manage investments (as an authorised investment/asset manager) is denied or when the FCA asks the applicant to withdraw its application.
  3. You refer to “investment managers” in the example provided your request. Can you confirm whether you would like us to consider the request in the context of all ‘registrations’ (which would also include investment managers) or whether you would like the request to be considered specifically for ‘investment managers’, as set out in your example.  Just focused on investment managers (e.g. hedge funds, private equity funds, etc).
  4. If it is the latter, the FCA does not recognise the term ‘investment managers’ as we do not have a marker field for that term. Instead we would look at firms that requested the regulated activity of ‘Managing Investments’ at initial application for authorisation.
