Examples of when we might publish this sort of information on the Disclosure Log would include where:

One of the service standards published by the FCA is “Service Standard [R6.1] – Statutory - To make a decision after receiving a ‘complete’ notification of a proposed change in control”. The service standards published by the FCA in May 2017 show that, during the period from April 2016 to March 2017, such service standard was met in 100% of Consumer Credit and Non Consumer Credit cases.

We are preparing an analysis on change in control applications under FSMA and, for the purposes of our analysis, it would be extremely helpful to receive from the FCA under the Freedom of Information Act 2000 the following information in respect of each financial year since the FCA was established on 1 April 2013:

1. how many Non Consumer Credit change in control notifications were received by the FCA in the relevant financial year

2. how many proposed controllers in the relevant financial year received from the FCA upon submission a written acknowledgement of receipt of a ‘complete’ Non Consumer Credit change in control notification

3. how many proposed controllers in the relevant financial year received from the FCA upon submission a written acknowledgement of receipt of an ‘incomplete’ Non Consumer Credit change in control notification

4. on average:

a. how many working days elapsed between the day a Non Consumer Credit change in control notification was submitted to the FCA and the day the FCA acknowledged in writing receipt of that change in control notification (whether the acknowledgement was of a ‘complete’ or ‘incomplete’ notification);

b. how many working days elapsed between the day a Non Consumer Credit change in control notification was submitted to the FCA and the day the FCA acknowledged in writing receipt of that change in control notification (in cases where the acknowledgement was of a ‘complete’ notification)

I'm interested in finding out how many times someone has contacted the whistleblowing team but it has been treated as a complaint rather than whistleblowing, meaning it has been passed onto the complaints team.

This information was provided to the The House of Lords European Union Committee who published a report on 15th December 2016 (HL paper 81) entitled “Brexit: financial services”.  by the Financial Conduct Authority, and I would like to submit a freedom of information request to obtain more information on the data presented in this table.

Specifically, I would like to request a list of the firms by name that currently have a passport to provide services into the UK (the inbound column on the table) under each directive (AIFMD, IMD, MiFID, and so on). I do not require a hard copy of the information as an electronic list will be satisfactory.

Background

The House of Lords European Union Committee published a report on 15th December 2016 (HL paper 81) entitled “Brexit: financial services”. Contained in Chapter 2 of that report was a table “table 2”, which stated the number of firms with at least one passport under each directive. For example, the table stated that under the Alternative Investment Fund Managers Directive, 45 firms have a passport into the UK to provide the services outlined in the directive.

This information was provided to the committee by the Financial Conduct Authority, and I would like to submit a freedom of information request to obtain more information on the data presented in this table.

On 20 September the FCA released to the Treasury Select Committee a statistical breakdown of the number of holders of incoming and outgoing EU 'passports', broken down by directive.

I would like to request a list of the names of individual companies and firms that retain 'passports'.  I would like the list broken down under each directive (i.e. the names of individual firms that hold passports under AIFMD, or IMD, or MiFID and so on).

Change in Control applications:

Individuals or companies that wish to acquire or increase control in a firm regulated by the FCA must seek the FCA's prior approval, according to the requirements of the Financial Services and Markets Act 2000 (FSMA).

In relation to such applications for approval, if the FCA rejects the approval, the individual / company seeking the approval can contest that decision and refer it to the Regulatory Transactions Committee (RTC).

It is against this context that I request the FCA to disclose the following:  

  1. the number of Change of Control applications received by the FCA in 2013, 2014, and 2015 (years ending 31st December) and 2016 (to date) respectively;
  2. the number of those applications received, per year, that were withdrawn by the subject firm / individual; and
  3. the number of those applications received, per year, that were rejected by the FCA.

No information has been published on how this decision was reached, except to say that the FCA believed it would be better "to encourage the delivery of cultural change through other routes". However, an inquiry is a work of investigation which leads to recommendations, whereas "encouraging the delivery of cultural change" implies that no investigation is needed or that it has been completed already.

I am interested in finding out the average length of time that 'skilled person reports' relating to insurance companies, and general insurance brokers, have remained 'open' since 2012.

Please define an 'open' skilled person's report (commissioned under Section 166) in a way that is matches FCA's processes and can be tracked by you; my understanding of the process is that a completed skilled person's report can result in two possible scenarios:

- After the skilled persons report has been received and reviewed by the FCA, the FCA decides that no further action will be taken and informs the skilled person or the firm concerned.

- The FCA holds a further meeting with either the firm concerned, the skilled persons, or both (if more than one meeting is required, please base your calculation on the date of the last meeting held).

I do not need to know about any subsequent monitoring by the FCA of any issues raised by the skilled persons report.  Please exclude any currently 'open' skilled persons reports from your figures.

If possible within the cost and time limits of the Freedom of Information Act, please also break the information down further and give separate figures for 'insurance companies' and 'insurance brokers'.

"1)  Which of the NDFA Lehman-backed brochures did the FSA examine as part of their review. 
2)  What did the FSA conclude regarding the compliance of each brochure examined under COBS rules and FSA Principles? 
3)  Did the FSA look at the invitation letter (copy attached) and reach a conclusion regarding the suitability as an approach to potential investors?  In particular did the FSA consider the statement that "Your capital is ONLY at risk if the FTSE 100 Index or Dow Jones EURO STOXX 50 fall by more than 50% from the Starting Index Levels" in relation to it being a false statement of inducement as per the Misrepresentation Act?"
