Our functions under the Regulated Covered Bond Regulations are separate from our functions under the Financial Services and Markets Act 2000 (FSMA) and under other applicable legislation.

We will approach any conflicts which may arise between such functions on a case-by-case basis (which may, for instance, include issues over whether depositors' interests are preferred over other creditors or vice versa) taking due account of all relevant factors. Admission to the register of issuers or bonds to the register of regulated bonds does not preclude or limit the scope of the our powers under FSMA and under other applicable legislation.
