Reference Case Number: FOI2025/00773

Freedom of Information: Right to know request:

Please can you confirm how many ‘on notice’ letters the FCA has issued to regulated firms between 2000 and 2025 to date?

By ‘on notice’ letters, we mean letters sent by the FCA to regulated firms putting them on notice of a potential competition law infringement.

Please provide the number of such letters issued split by calendar year so we can see how many were issued by the FCA in each calendar year.

FCA response:

We can confirm that we hold the requested information, which is set out in Annex A below.

The FCA began issuing On-Notice letters in 2015 in parallel with the commencement of the FCA’s concurrent competition powers. The table below shows how many On-Notice letters the FCA has sent to any firm in each calendar year since 1 January 2015. For the purpose of this response, 2025 indicates the period from 1 January 2025 to 4 September 2025.

The FCA does not specifically record whether an addressee of an On-Notice letter is regulated by the FCA. The FCA issues On-Notice letters regarding competition matters that fall within the FCA’s concurrent competition enforcement remit, that is, relating to the provision of financial services. This is not limited to regulated firms. The below information pertains to all these matters.
