Reference Case Number: FOI11478
Freedom of Information: Right to know request:
Please confirm how many times firms have received enforcement action from the Financial Conduct Authority (FCA) for failure to adhere to FCA DISP Rules 1.1. Please focus on the last 5 year period, within the cost limit.
FCA response:
We have interpreted your request as relating to breaches of DISP 1 more broadly (i.e. breaches of rules on how respondents should deal with complaints promptly and fairly, including complaints that could be referred to the Financial Ombudsman Service) as DISP 1.1 specifically relates to the purpose and application of the rules.
On that basis, following a thorough search of our records, we can confirm that the FCA has taken enforcement action for failure to adhere to DISP rules on one occasion in the last five years. Further details of the enforcement action taken on that occasion can be found in the relevant Final Notice, here - Final notice 2020: Lloyds Bank PLC, Bank of Scotland plc, and The Mortgage Business Plc (fca.org.uk)
