Information on Applications to perform Senior Management Functions - February 2021

Follow-up to FOI7905:

 

I am happy to omit Item 1c (relating to 'non-routine' applications) from my request if this would exceed the cost limit. I would like to proceed with a refined request covering Items 1a, 1b, 1d to 1g (inclusive) and Items 2 to 5 (inclusive)

 

1. Please confirm the following information for each calendar year since 2016 (broken down by each calendar year i.e. for each of 2016, 2017, 2018, 2019 and 2020):

 

1a. The total number of applications that the FCA has received for individuals to perform one or more Senior Management Functions. I note that the FCA's website states that the FCA publishes this information every six months, but I have been unable to locate this information online.

 

1b. Out of the applications referred to in 1a. above, the number of individuals who were interviewed by the FCA as part of the FCA's process for determining whether it should approve these individuals to perform one or more Senior Management Functions.

 

1d. Out of the applications referred to in 1a. above, the number of applications in respect of which the FCA has made recommendations to the Regulatory Transactions Committee. I note that the FCA provided this information for 2016, 2017, 2018 and 2019 (in part) in a previous response to a FOIA request (https://www.fca.org.uk/publication/foi/foi6914-response.pdf) so I would be grateful if the FCA could supplement this information in its response to this request to cover the remainder of 2019 and 2020.

 

1e. Out of the applications referred to in 1a. above, the number of applications in respect of which the FCA has made recommendations to the Regulatory Decisions Committee. I note that the FCA provided this information for 2016, 2017, 2018 and 2019 (in part) in a previous response to a FOIA request (https://www.fca.org.uk/publication/foi/foi6914-response.pdf) so I would be grateful if the FCA could supplement this information in its response to this request to cover the remainder of 2019 and 2020.

 

1f. Out of the applications referred to in 1a. above, the number of applications that have been refused/rejected by the FCA.

 

1g. Out of the applications referred to in 1a. above, the number of applications that have been withdrawn by the relevant firm and/or candidate.

 

2. Please confirm for each calendar year since 7 March 2016 (broken down by each calendar year i.e. for each of 2016, 2017, 2018, 2019 and 2020) the number of 'qualified' Form Cs received by the FCA in respect of individuals who performed one or more Senior Management Functions. For the purposes of this request, I have used the term 'qualified' in the way that it is described on the FCA's website - https://www.fca.org.uk/firms/approved-persons/change-cancel-approval-controlled-function.

3. Please confirm the following information for the period 7 March 2016 to present (there is no need for the FCA to provide this information broken down by calendar year):

 

3a. The total number of FCA enforcement investigations that the FCA has opened into individuals who hold/held one or more Senior Management Functions.

 

3b. The total number of enforcement investigations that the FCA had into individuals who hold/held one or more Senior Management Functions that were discontinued with no enforcement action being taken.

 

4. Please confirm the following information for the period 7 March 2016 to present (there is no need for the FCA to provide this information broken down by calendar year):

 

4a. The total number of FCA enforcement investigations that the FCA has opened into individuals who are/were classified by their firm as Certified Persons.

 

4b. The total number of enforcement investigations that the FCA had into individuals who are/were classified by their firm as Certified Persons that were discontinued with no enforcement action being taken.

 

5. Please confirm the following information for the period 7 March 2017 to present (there is no need for the FCA to provide this information broken down by calendar year):

 

5a. The total number of FCA enforcement investigations that the FCA has opened into individuals who are/were subject to the FCA's Code of Conduct (but were not a Senior Manager or a Certified Person).

 

5b. The total number of enforcement investigations that the FCA had into individuals who are/were subject to the FCA's Code of Conduct (but were not a Senior Manager or a Certified Person) that were discontinued with no enforcement action being taken.
