Please provide copies of the responses received for question 3 in the Consultation on Guidance to the anti-greenwashing rule (GC23/3). Please see Annex A for full details of your request. Further, you confirmed by email on 26 May 2024 that you were interested in all responses, not just those from organisations.

Of the 69 responses received to the anti-greenwashing consultation (GC23/3), 57 included a response to question 3.
There were 5 respondents who explicitly requested confidentiality. We are prohibited from disclosing the details of these responses to you, as they constitute ‘confidential information’ for the purposes of section 348 of the Financial Services and Markets Act 2000 (FSMA), which the FCA has received in the discharge of its public functions. We are therefore exempted from the duty to disclose this information under section 44 of FOIA. For more information on why this exemption applies, please see Annex B.
Copies of the remaining 52 non-confidential responses received to question 3 can be released to you outside of FOIA as routine correspondence and will shortly be sent to you under a separate cover by the relevant business area.
