FCA response:

In respect of the information you have requested, we can provide some of it to you, as set out in the attached document (Annex B).

Regarding all other relevant information which we hold, we are exempted from providing it to you because section 36 (prejudice to the effective conduct of public affairs) of FOIA applies.

This is because, for the reasons set out in Annex C below, we are of the view that disclosing this information would be likely to restrict the free and frank exchange of views when considering issues and could prejudice the effective conduct of public affairs.

In addition, some of the information within scope contains the personal information of individuals other than yourself, where we consider disclosure would not be in accordance with the UK GDPR.  We are therefore exempted from disclosing it to you under section 40 (Personal information) of FOIA.

Finally, we are prohibited from disclosing some of the information because it is ‘confidential information’ for the purposes of section 348 of the Financial Services and Markets Act 2000 (FSMA) and which the FCA has received in the discharge of its public functions.  We are therefore exempt from the duty to disclose it to you under section 44 (Prohibitions on disclosure) of FOIA.
