Freedom of Information: Right to know request:
We have been made aware that the FCA wrote to several stakeholders, including banks, associated with the 79th Group in October/November 2024, raising their concerns around the trading of the group.
Please provide a copy of this letter and any associated correspondence at your earliest convenience.
FCA response:
We can confirm that we hold the information you have asked for and we have attached a copy of the letter sent to ‘several stakeholders, including banks, associated with the 79th Group’ (see Annex A). Please note the letter was sent jointly by the FCA and PSR in October 2025.
In respect of your request for ‘any associated correspondence’, we have interpreted this to mean any correspondence directly or specifically related to the letter to the banks. We are prohibited from providing this information to you as it is, or contains, 'confidential information' for the purposes of section 348 of the Financial Services and Markets Act 2000 (FSMA) and which the FCA has received in the discharge of its public functions. Therefore, for the reasons set out in Annex B below, we are exempted from the duty to disclose this information under section 44 of FOIA.
