Reference Case Number: FOI2026/01954
Freedom of Information: Right to know request:
I notice in your published enforcement data for the financial year 2022/23 - link here: FCA operating service metrics 2022/23 | FCA[1] - you provided at Table 2 a breakdown of your "open cases at end of financial year [....] by primary issue under investigation and case type". This data was presented in the form of a table, with numbers of cases categorised by primary issue under investigation and whether you treat it as civil/criminal/dual track and regulatory.
However in the three financial years that have passed since then, you have not provided this information in your annual enforcement data releases.
I would be very grateful if you could, for each of the three financial years since 2022/23 (ie 23/24; 24/25 and 25/26) provide me with a detailed breakdown of the open enforcement operations at the end of the period in question. I would be grateful if you could please provide this data in the same format, and to the same level of detail, as you did in Table 2 of the 2022/23 enforcement data release.
FCA response:
We can confirm that we hold some of the requested information.
Due to changes in the way we record issues against investigations, the data we hold is no longer aggregated using the primary issue categories referred to in the request.
Enforcement data published for 2023/24[2] and 2024/25[3] was reported at an operational level and aligned to the FCA's strategic commitments, rather than by primary issue category.
We have been able to map 2023/24[2] data into the requested format. Please see the table below.

At the end of each financial year, we go through a rigorous reconciliation and mapping exercise in line with publication decisions based on our strategy. As explained earlier in our response, we have changed the way we record issues against investigations. We try and minimise the impact of using different reporting criterion but sometimes this is unavoidable. We are unable to map the data for 2024/25[3] and 2025/26[4] into the requested format. However, the tables below provide a breakdown of open investigations where the primary issue aligns with one of the categories specified in the request. Where investigations do not align with any of those categories, based on the data we hold, they have been included under "Other".
